Because of this, it is impossible for the Publisher to guarantee that the publisher’s provision of the services will be uninterrupted, that the Advertiser or public will be able to properly access and use the services or the work product of the Publisher, or that such services will be provided without error.

 

Advertiser further agrees that participation with the 78704.net Internet Advertising Index site does not constitute opportunity to bring about or otherwise cause a wide-scale distribution of messages to inappropriate mailing lists, newsgroups, or other public or private forms online or in the real world; the propagation of so-called computer worms or viruses; or to participate in or otherwise cause unsolicited electronic mailings to individuals or businesses.

 

The Publisher’s entire liability and the Advertiser’s exclusive remedy against the Publisher for failure of service under this agreement, or the performance or non-performance of any obligation under this agreement, shall be limited to a refund of unused amounts paid to 78704.net as stated on this form.

 

All agreement(s) between Advertiser and Publisher will be in writing signed by both parties and constitute the entire agreement of the parties relative to subject matter.

 

Advertiser agrees that designated contact person is the sole contact between Advertiser and Publisher and if said person is not the Advertiser the contact person has the authority to act for the Advertiser.
